There are certain procedures the Police must follow when stopping someone for speeding. They must tell you why you were stopped & caution you aswell as showing you the speed on the radar/laser detector. If he didn't do this, then it will get thrown out of court......unless he lies under oath, in which case you're stuffed because Magistrates are more likely to believe a respectable Police Officer than a young 'scallywag' driving a modded CTR!

Correct. I got 'done' by an unmarked that followed me up a stretch of dual carriageway recording me on video with his speed in the bottom corner. He just so happened to catch me at a silly moment, I was in a bit of a hurry and a car full of lads in a corsa were blocking the outside lane struggling to do 70, they eventually pulled over just as the road goes from being dual carriageway on both sides to single on the other direction and dual on my side but no barrier, hence the limit drops from 70 to 60. In my annoyance at these 'youts' I booted up the hill not noticing the sneeky beemer following me. Slowed down when over the hill only to notice the blues & twos. I wasn't sure of my exact speed but I knew straight away it was instant ban territory. I was very nice to the bloke and apologetic without admiting anything and he sat down and showed me the vid (which I must admit did look pretty cool as the back dumped down on the CTR and he tried to keep up :-D )

Anyway I don't think it's wise to post my speed on here and it's not something I'm proud of but he basically explained that he understood my annoyance and the lads in the corsa but my actions weren't justified and if I would accept his offer of 3 points he wouldn't send me to court. hmmm let me think about that!?

So that was a long way round of saying yes they can do you on their own with video evidence and also being nice and not attitudy goes along way.

Lessons were learned.

I am no laeyer but I bet this one goes no where

On a side note... sounds likes your attutude was a bit crap when he pulled you.. in 18 years of driving I have never got a ticket or any points on my license (been stopped a few times).. as galling as it is here are my tips
- always get out of the car and go to the cop car if safe to do so
- always say please and thankyou (be polite)
- don't be cocky, belligerent or a smartarse
- admit that you may have been going too fast but never say how fast

You will have to have a hot shower to feel clean afterwards but it has always got me out of trouble.. most of the time these guys just want you to be aware that you were speeding and made a mistake and give you a talking to and a slap on the wrist (but of course you will always het a few wankers that just want you for breakfast)
Yeh similar to alot of the experiences on here, I've always gone with the 'be honest' apparoach (without dropping yoursefl completely in it!!).

I got caught by a sneaky police unit hiding down a side road... pre CTR this is mind and I was young  . Either way it was a 30mph zone BUT led to a dead end (old airfield), houses only on 1 side but set a long way back from the road. Either way I was obviously doing alot more than the limit. He caught up with me and I just admitted to doing "around 60", agreed with him and took a good 10 minute b*llocking - and he let me off :salut:

good point he didnt even caution me, didnt think of that.. as for the rest i said i didnt know the guy in the red type R, and in court i will say i was just overtaking him (as it where on the dual lane caridge way, no white lines etc) and also the picture will just look like that if he took one, or even video'd it.

going be a sticky one this, going seek legal advice because theres a few things he didnt do / conform to for my liking so not going to bite the bullet just yet...

and LOL @ vtec kicked in y0 hahaha

funnily he said i heard a uniqe noise to this sort of car, i was gagging to say somthing

By memory mate he should have at least cautioned you, showed you the evidence and if you asked then he should have been able to tell you if the gun had been calabirated before the session. If none of these were done/supplied then you got more of a case.

Worse comes to worse make sure you get copies of documentation about when and how the gun was calabirated (should be before and after the session on the day or no more than a week or so ago) If not you can argue that the gun was unreliable and so puts doubt on their case. Remember, it is "beyond all reasonable doubt" which is a very high threshold. You can get all this information when Court proceedings commence and if not then under the Freedom of Information Act.

I wouldnt worry mate, i cant see how he got a reading of off a hand held laser gun when he was travelling, at 40mph because you have to be stationary...and if he was by himself, it wont hold up in court as you need 2 policemen minimum to prosecute someone for something. Other wise its your word against his. If he didnt show you the readings, which he has too, then he blatently has nothing on you and hes trying to just scare you.

i got caught doing 130mph with a gun and he was stationary and showed me on hes camera my speed over a certain distance...i got summoned to court and got 2 week ban and 100pound fine,,, no points! go figure! lol that was a few years ago ive grown up and learned my lesson now though! haha

well i know with them vascar's they have to follow you for at least half a mile as my dad got caught on his bike last year and thats what solicitor said. and the fact he showed you nothing makes it seem a bit fishy and he putting the shits up you.

have you been sumond yet or are you still waiting? lets know how you get on but think you prob hear nothing or get off with it

www.pepipoo.com is your friend, seriously they will tell you the ins and outs of everything that happened.

I cant remember if its this or the certificate for the gun but they are not obliged to show you anything.

Also they would have to be stationary to get an accurate reading with the gun as they have to point the laser at one point on your car (no. plate) for a few seconds to get an accurate reading. Not really possible whilst driving as they hold it with two hands.

Go back and check the road for speed signs or repeaters telling you the speed, as they may have been removed? but im guessing you just missed them :P

I had a similar issue years back, and had to take it

Was about 10 years ago when I was a nipper and was out in my newly acquired fiesta rst, I was going a bit fast to be fair and it was about midnight so nothing on the roads and stuck out like a sore thumb. Anyhow, i came out of a side road onto a main road then took a right through a green light - all abit sharpish but not stupid.

I travelled about 1/4 of a mile with NOTHING behind me, then suddenly BANG blue lights and a police car all over my bumper. I pulled over and got took to the police car :???:

The police officer says 'you were doing 70mph at one point (b*llocks) but got you at an average of 50mph over a quater mile' (thats still sounded a bit offy to me) He then went to say 'I have have you on camera' reaching round to put his hand on it, but stopped suddenly and then said 'if you want it to go to court you will get done for doing 70mph or can accept and sp30 on the spot'

Now, I accepted this, despite the fact that they had NOT been behind me, but had seen me take the junction earlier, then they cut through and came out behind me further down the road immediately slamming the blue and two's on, and the copper almost seemed to be going throught the motions ref the camera then seemed to hold, as if he just realised i wasn't on camera as he wasn't behind me.

BUT, considering the tyres where iffy, and the car was insured as standard but might not have been  So I happily accepted a £60 fine and 3 points and went straight home.

In a way it taught me a few lessons

a) make sure your car is fully road legal and insured properly
b) don't drive like a tit as you never know who is watching or waiting
c) Coppers will always win, or make things a total pain if you try to get clever.
