Where does the law stand on this these days, not really on about the driver as I always where my seatbelt no issues with that, but when passengers don't wear the seatbelt in a car/van

Is it the driver who would be fined/points given ???

If the person not wearing a seat belt is a child under the age of 14 then it is the drivers responsibility to ensure they wear it unless they are medically exempt etc. this offence now carries a fine of £60 but no points. Otherwise if the person not wearing the seat belt is 14 years or older then it is their responsibility.
